1. Acceptance of these Terms
These Terms of Service govern your use of apothify.com (the "Site") and any products, services, content, and features Apothify offers through it. By visiting the Site, creating an order, subscribing to email updates, or otherwise interacting with the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
2. About Apothify
Apothify is operated by Apothify LLC, a Wyoming limited liability company with its registered office at 30 N Gould St., Sheridan, WY 82801, United States. "Apothify," "we," "us," and "our" in these Terms refer to Apothify LLC. Apothify operates a peptide research library and a related catalog of reference compounds offered for laboratory research use. Apothify is not a pharmacy, a healthcare provider, a clinical research organization, a compounding facility, a supplement company, a food company, or a cosmetics company. Nothing on the Site is medical advice and nothing on the Site is intended to diagnose, treat, cure, mitigate, or prevent any disease.
3. Eligibility
You must be at least 21 years of age to purchase from Apothify. By placing an order you confirm that you are 21 or older, that you are acquiring the product for laboratory research use only as defined in the Research Use Disclaimer, and that if you are purchasing on behalf of an organization you have authority to bind that organization to these Terms. Apothify may decline or cancel any order at its discretion.
4. Research use only and prohibited uses
All products offered for sale on the Site are reference compounds supplied strictly for in vitro laboratory research. The products are not drugs, supplements, food, cosmetics, or medical devices, and they are not for human consumption, animal consumption, clinical use, or compounding. The full scope of permitted and prohibited uses is set out in the Research Use Disclaimer, which is incorporated into these Terms by reference. By purchasing from Apothify you agree to be bound by that disclaimer.
5. Site content and accuracy
Apothify publishes educational content on peptides, categories, comparisons, and a guided peptide finder. This content is research framing only. It is not a protocol, a recommendation, or a prescription. Apothify makes reasonable efforts to keep the content accurate and current but does not warrant that the content is complete, up to date, or free of error. You are responsible for verifying any specific claim against the primary literature or the manufacturer documentation before relying on it for research work.
6. Account and order information
When you place an order you must provide accurate contact, shipping, and billing information. You authorize Apothify to use that information to process the order, communicate with you about it, and meet legal recordkeeping requirements. You are responsible for keeping your email address current so that order communications reach you.
7. Pricing, taxes, and payment
All prices are shown in United States dollars and may change without notice. Sales tax is calculated and collected where applicable. Accepted payment methods are listed at checkout. Card orders ship after the payment is captured and compliance review completes. ACH, Cash App, and crypto orders ship after the payment is confirmed. Check and money order payments ship after the payment clears. Additional payment terms are set out in the Payment Policy.
8. Compliance review and order cancellation
Apothify performs compliance review on orders. This includes age and identity checks, address verification, watchlist screening, and review of the product mix in the order. Apothify may hold, cancel, or refuse any order at its discretion based on this review or for any other lawful reason. If an order is cancelled after payment, the payment is refunded to the original method.
9. Shipping, delivery, and risk of loss
Apothify ships to addresses within the United States only. Shipping methods, cutoff times, and delivery windows are described in the Shipping Policy. Risk of loss passes to you when the carrier scans the package as delivered. If a shipment is damaged, incorrect, or marked delivered but not received, follow the process in the Refund Policy.
10. Returns and refunds
Because every product is supplied for laboratory research use only, return eligibility is narrow and is governed by the Refund Policy. Read it before purchasing.
11. Chargebacks
If you have a question or a problem with an order, contact support@apothify.com first. Most issues are resolved within one business day. Filing a chargeback without first contacting Apothify wastes everyone's time and increases costs for all customers. Apothify retains checkout logs, delivery records, acceptance records, IP and user agent data, and item snapshots for every order, and will submit those records to the bank and card network if a dispute is filed. 12. Promotions and discounts
Promotional codes, discounts, free shipping thresholds, and any other promotional terms are subject to the conditions stated where the offer is presented and may be modified or withdrawn at any time. Promotions cannot be combined unless expressly stated. Promotions cannot be applied to a completed order after the fact.
13. Intellectual property
All content on the Site, including the Apothify name, logo, design system, copy, photography, library entries, comparison tool, peptide finder, and the underlying software, is the property of Apothify or its licensors and is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws. You are granted a personal, non transferable, revocable license to view the Site for your own research and purchasing purposes. You may not copy, scrape, redistribute, mirror, frame, or create derivative works from the Site or its content without written permission. Brief quotations with proper attribution are permitted for normal review and reporting use.
14. User submitted content
If you submit feedback, suggestions, questions, or other content to Apothify, you grant Apothify a perpetual, royalty free, sublicensable, worldwide license to use that content for any business purpose, including improvement of the Site and the catalog. Do not submit confidential information you do not want Apothify to use.
15. Acceptable use
You agree not to use the Site to: (a) violate any law or regulation; (b) attempt to access any part of the Site, account, or data that is not intended for you; (c) probe, scan, or test the vulnerability of the Site or any underlying system without prior written permission; (d) interfere with normal operation of the Site, including by sending automated traffic at a rate that degrades service; (e) post or transmit any malicious code; or (f) misrepresent your identity or your eligibility to purchase.
16. No warranty
The Site and the products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Apothify disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, non infringement, and quiet enjoyment. Apothify does not warrant that any product is biologically active, sterile, endotoxin free, GMP grade, USP grade, or pharmaceutical grade unless the product page expressly states otherwise. No oral or written information or advice given by Apothify or any representative creates a warranty not stated in these Terms.
17. Limitation of liability
To the maximum extent permitted by law, Apothify, its officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or related to the Site or the products, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Apothify has been advised of the possibility of such damages. In any event, Apothify's total cumulative liability arising out of or related to these Terms or the products will not exceed the greater of the amount you paid Apothify in the twelve months immediately preceding the event giving rise to the claim or one hundred United States dollars. Some jurisdictions do not allow certain disclaimers or limitations; in those jurisdictions Apothify's liability is limited to the maximum extent permitted by law.
18. Indemnification
You agree to indemnify, defend, and hold harmless Apothify and its officers, directors, employees, contractors, and affiliates from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Site, your purchase or use of any product, your violation of these Terms, your violation of any law, or your violation of any right of another party.
19. Dispute resolution
Before filing any formal claim, both parties agree to try to resolve the dispute in good faith by contacting support@apothify.com and providing a written description of the dispute and the relief sought. If the dispute is not resolved within thirty days, either party may proceed under this section.
Any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except that either party may bring an individual action in small claims court if eligible. The arbitration will be conducted in English, by a single arbitrator, and held remotely or in the United States county of the customer's billing address, at the customer's option. Judgment on the arbitration award may be entered in any court of competent jurisdiction. The arbitrator may award injunctive relief only to the extent necessary to provide relief warranted by the individual claim.
You and Apothify each agree that any claim may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
If you do not want to be bound by this arbitration and class action waiver, you must send written notice of opt out to support@apothify.com with the subject line "Arbitration opt out" within thirty days of your first purchase. The notice must include your full name, the email address on the order, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
20. Governing law
These Terms and any dispute arising out of or related to them are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law principles. For any claim not subject to arbitration, the parties agree to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
21. Electronic communications and electronic acceptance
By using the Site you consent to receive electronic communications from Apothify, including emails about your order, your account, security and policy updates, and (if you opt in) research updates. Your acceptance of these Terms at checkout is recorded with a version stamp, IP address, user agent, and timestamp and stored as part of your order record. That record establishes the version of these Terms in effect for your order.
22. Severability
If any provision of these Terms is held to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the rest of these Terms will remain in full force.
23. No waiver
Apothify's failure to enforce any provision of these Terms is not a waiver of its right to do so later.
24. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without Apothify's prior written consent. Apothify may assign or transfer its rights and obligations without notice or consent, including in connection with a merger, acquisition, financing, or sale of assets.
25. Entire agreement
These Terms, together with the Privacy Policy, the Research Use Disclaimer, the Refund Policy, the Shipping Policy, the Payment Policy, the Chargeback Policy, the Cookie Policy, and any additional terms presented to you at checkout or in product pages, constitute the entire agreement between you and Apothify with respect to the Site and the products.
26. Changes to these Terms
Apothify may update these Terms from time to time. The version stamp at the top of this page reflects the current version. The version in effect for any given order is the version you accepted at checkout for that order. Continued use of the Site after a change indicates acceptance of the updated Terms.
